When a case is prosecuted, it is not done so by the Crown or the Crown Prosecution Service. Any person or organization may file a private lawsuit. Section 6(1) of the Prosecution of Offenses Act of 1985 specifically reserves the authority to bring private prosecutions, which require specialized solicitors or attorneys. For all other purposes, the prosecution is treated exactly the same as if it were being brought by the Crown, with the exception of the fact that it is being prosecuted by a private person or company.

A private prosecution has several benefits; it is nearly always quicker, more focused, and more effective than a public prosecution, particularly when fraud is involved. When the police or child protective services (CPS) have declined to look into or prosecute a crime, when a state prosecution has failed, or when a person or a firm wants more control over the timing and handling of their criminal case, they may use a private prosecution. Fraud prosecutions may be employed in a variety of situations, including when a person or organization knowingly makes a false statement with the goal of hurting another person or making money.

Instead of relying on the police or CPS, the client in a private prosecution manages the investigation and prosecution's pace.
